Terms and conditions of sale

These conditions of sale are concluded on the one hand by the company Aubercy, through the website aubercy.com, company with capital of 75 000 euros which head office is at 34 rue Vivienne, 75002 Paris, registered in the Register of Commerce and companies of Paris under number 302 664 636 hereinafter called « AUBERCY SAS” and on the other hand, by any person or entity whishing to make a purchase via the website Aubercy called hereinafter “the client”.

These terms and conditions aim at defining the contractual relationship between the client and Aubercy and conditions applicable to all purchases made through the online shop of Aubercy by the client, either professional or consumer.

The acquisition of property or services through the website Aubercy implies acceptance by the customer of these conditions of sale.

These conditions shall prevail over any other general or special conditions not specifically approved by Aubercy.

Aubercy reserves the right to modify terms and conditions at any time. In this case, the conditions will be those in force at the date of the order by the customer.

Characteristics of goods and services: products and services are those listed in the catalog published on the website of Aubercy.

These products and services are offered within the limits of available stocks.

Prices

Prices are listed in the catalog price in euros including all taxes.
Aubercy reserves the right to change prices at any time and without notice, it is understood that the price shall be the one listed in the catalog on the day of the order.

Geographical area

The online sale of products and services presented in this wesite is for buyers who live in France, overseas territories or in Monaco and in all countries, except those who are not served by our transport and deliveries required in these areas.

Order

Customer orders can be made either via the website Aubercy. 

The customer wishing to purchase a product at Aubercy must first fulfill some steps:

  • Enter his username and password that were transmitted during his first purchase (If he is already a customer)
  • Otherwise, complete the identification form with all its customer information (Name, Address, Telephone, E-mail).
  • Choose the product (model, quantity, size …) and complete the delivery information.

Choose your payment method, confirm the order and pay

The order will be definitively accepted by Aubercy after confirmation of payment by the company Crédit du Nord, our provider for the validation of electronic payments. This acceptance may take several minutes for a customer having already made purchases and have already been approved by Crédit du Nord, a few days if the customer has to provide information requested by Crédit du Nord.

The confirmation of the order implies acceptance of these terms of sale, the recognition of having perfect knowledge and waiver of its own conditions of purchase or other conditions.

All data recorded and confirmed can be used as proof of the transaction. Confirmation is worth signing and acceptance of transactions. Aubercy will email confirmation of the order recorded.

Aubercy reserves the right not to honor an order in case of pending litigation with a client.

Availability

Product availability is indicated on the site at the time of the order. Aubercy agrees to fulfill orders only within the limit of available product stock. In case of unavailability of a product at the time of preparation of the order in our warehouse, Aubercy undertakes to inform the customer by mail, as soon as possible. In this case, depending on the customer’s request, the order will be stored and processed as soon as the new product is available, or canceled and the amount refunded if it is not.

Withdrawal / exchange

The customer has within 30 days to retract from the date of delivery to the address specified by the customer. Then he can  either be reimbursed for the product or request a trade. Purchases made directly into our showroom are excluded from this clause and remain permanently acquired by the customer.

The product must:
  • Be returned new and in original packaging. Aubercy controls all products and reserves the right to refuse a return in case of non compliance. The product will be returned to the customer’s expense.
  • Have been a request for return either in “Contact us” section or” in “My Account” section on Aubercy website.
  • Insert the return voucher in the return package.

Shipping costs are not refundable except for defective items or items sent in error.The customer must then return the product in the postal manner indicated by Aubercy in the request for return.

Return costs are the responsibility of Aubercy if the client lives in France and if he uses the label colissimo return received with your package. For those who lost the label, they can return the package by colissimo (out of package pre-stamped). The costs of returning (at your expense) will be converted to a credit on future purchases, calculated on the basis postal rates of colissimo (without packaging pre-stamped). Abroad, customers are charged of return costs.
The return postage is the responsibility of Aubercy for the French territory only.

Repayment terms

Refunds will be made at the discretion of Aubercy or by crediting the customer’s bank account or by check sent to the name and address of the customer. The deadline for resolution is 3 weeks from confirmation of payment.

The price is payable to the order.

Shipping

Deliveries are made to the address listed in the order.

Aubercy delivers the customer within 3 to 6 working days. Aubercy books in most countries under the conditions of time and rates in effect at the post office. We can not guarantee delivery times outside of mainland France.

Guarantee

All products supplied by the Aubercy website benefit from the legal guarantee provided for Articles 1641 et seq of the Civil Code. In case of non compliance of a product sold, it can be returned to Aubercy who will exchange or refund under the terms of these general conditions of sale.
 All complaints, requests for exchange or refund must be made by mail at the following address contact@aubercy.com within thirty days of delivery.

Responsibility

Aubercy, in the process of selling online, is only bound by an obligation of means. His liability can not be held liable for damages resulting from the use of the Internet such as data loss, intrusion, viruses, break service, or other unintended problems.

Intellectual Property

All elements of the Aubercy website are and remain the exclusive intellectual property of Aubercy. Nobody is allowed to reproduce, use, repost, or use for any purpose whatsoever, even partially, the elements of the website even if they are software, visual or sound.

Personal Data

According to the law relating to computers, files and freedoms of January 6, 1978, the information containing names of buyers may be subject to automated processing.
 Aubercy reserves the right to collect information on purchasers including by using cookies, and, if desired, transmit to business partners collected information. Filing – Proof

Aubercy archives purchase orders and invoices on a reliable and durable file used as a true copy in accordance with the provisions of section 1348 of the Civil Code.
The registers of Aubercy will be considered by the parties as proof of communications, orders, payments and other transactions between the parties.

Dispute resolution

These conditions of online sales are subject to French law.
 In case of dispute, jurisdiction is assigned to the competent courts of Paris, despite multiple defendants or guarantee.
